• Any person who is designated by a Florida court as a habitual violent felony offender, a three-time violent felony Offender, a Violent Career Criminal, or a Prison Releasee reoffender AND is serving sanctions or was released from sanctions in Florida on or after July 1, 2002, has a lifetime requirement to register as a career offender. Florida Statute 775.261

• A career offender must register:
  • At a Florida sheriff’s office in the county in which the career offender establishes or maintains a permanent or temporary residence in this state;
  • Within 2 working days after establishing permanent or temporary residence in Florida; or
  • Within 2 working days after being released from the custody, control, or supervision of the Department of Corrections or from the custody of a contractor-operated correctional facility, or local detention facility.
• During registration, the career offender shall provide the following information:
  • Name
  • Social Security Number
  • Age
  • Race/Sex
  • Height/Weight
  • Hair/Eye Color
  • Take a Photograph
  • Address of legal residence
  • Address of any current temporary residence within the state or out of state
  • Date/Place of Employment
  • Conviction Information
  • Brief description of Crime(s) committed as a career offender

Habitual Violent Felony Offender

F.S. 775.084(1)(b) defines “habitual violent felony offender” as a defendant convicted of committing or attempting/conspiring to commit a qualifying felony offense who had been previously convicted of committing or attempting/conspiring to commit one or more qualifying felony offenses where the new offense was committed:

• While the defendant was serving a prison, supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony; or
• Within 5 years of the date of the conviction of the last prior enumerated felony, or within 5 years of the defendant’s release from a prison, supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony, whichever is later.

Qualifying felony convictions include the following offenses:

• Arson
• Sexual battery
• Robbery
• Kidnapping
• Aggravated child abuse
• Aggravated abuse of an elderly person or disabled adult
• Aggravated assault with a deadly weapon
• Murder
• Manslaughter
• Aggravated manslaughter of an elderly person or disabled adult
• Aggravated manslaughter of a child
• Unlawful throwing, placing, or discharging of a destructive device or bomb
• Armed burglary
• Aggravated battery or
• Aggravated stalking

Three-time Violent Felony Offender

F.S. 775.084(1)(c) defines “three-time violent felony offender” as a defendant convicted of committing or attempting/conspiring to commit of a qualifying felony offense who had been previously convicted of committing or attempting/conspiring to commit two or more qualifying felony offenses where the new offense was committed:

• While the defendant was serving a prison, supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony; or
• Within 5 years of the date of the conviction of the last prior enumerated felony, or within 5 years of the defendant’s release from a prison., supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony, whichever is later.

Qualifying felony convictions include the following offenses:

• Arson
• Sexual battery
• Robbery
• Kidnapping
• Aggravated child abuse
• Aggravated abuse of an elderly person or disabled adult
• Aggravated assault with a deadly weapon
• Murder
• Manslaughter
• Aggravated manslaughter of an elderly person or disabled adult
• Aggravated manslaughter of a child
• Unlawful throwing, placing, or discharging of a destructive device or bomb
• Armed burglary
• Aggravated battery or
• Aggravated stalking
• Home invasion/robbery
• Carjacking or
• An offense which is in violation of a law of any other jurisdiction

Violent Career Criminal

F.S. 775.084(1)(d) defines “violent career criminal” as a defendant convicted of committing or attempting/conspiring to commit of a qualifying felony offense who had been previously convicted of committing or attempting/conspiring to commit three or more qualifying felony offenses where the new offense was committed on or after October 1, 1995 and:

• While the defendant was serving a prison, supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony; or
• Within 5 years after the conviction of the last prior enumerated felony, or within 5 years after the defendant’s release from a prison, supervision, or other sentence imposed as a result of a prior conviction for an enumerated felony, whichever is later.

Qualifying felony convictions include the following offenses:

• Any forcible felony, § 776.08
• Aggravated stalking, § 784.048(3) and (4)
• Aggravated child abuse, § 827.03(2)
• Aggravated abuse of an elderly person or disabled adult, § 825.102(2)
• Lewd or lascivious battery, lewd or lascivious molestation, lewd or lascivious conduct, or lewd or lascivious exhibition, § 800.04
• Escape, § 944.40 or
• A felony violation of Chapter 970 involving the use or possession of firearm

Prison Releasee Reoffender

F.S. 775.082(9) defines “prison releasee reoffender” as a defendant who commits or attempts to commit a qualifying felony offense:

• Within 3 years after being released from the Department of Corrections for an offense that is punishable by more than 1 year; or
• While serving a prison sentence or on escape status from the Department of Corrections, following an incarceration for an offense that is punishable by more than 1 year.

Qualifying felony offenses include:

• Treason
• Murder
• Manslaughter
• Sexual battery
• Carjacking
• Home-invasion robbery
• Robbery
• Arson
• Kidnapping
• Aggravated assault with a deadly weapon
• Aggravated battery
• Aggravated stalking
• Aircraft piracy
• Unlawful throwing, placing, or discharging of a destructive device or bomb
• Any felony that involves the use or threat of physical force or violence against an individual
• Armed burglary
• Burglary of a dwelling or burglary of an occupied structure or
• Any felony violation of s. 790.07, s. 800.04, s. 827.03, s. 827.071, or s. 847.0135(5)

• The Florida Career Offender Registry is updated on a “real time” continuous basis as new information is received from FDLE’s criminal justice partner agencies.

• No, Florida is currently the only state that maintains a Career Offender Registry. However, other states may require “convicted felons” to register. If moving to a new state, career offenders are encouraged to check with local authorities in that state to see if a “convicted felon” registration is required.

• Florida’s career offender registration laws do not impose a residency restriction on career offenders, nor is there a Florida Statute that imposes a residency restriction. • Failure of a career offender to register as required by law is a 3rd degree felony.

• Career offender registration is a lifetime requirement unless the registrant receives a full pardon, or the qualifying conviction is set aside. However:
  • A career offender, if eligible, may file a petition through the clerk of court in the county of residence after 20 years of lawful release from confinement, supervision, or sanction AND have had no arrests for any offenses since release.
  • The court may grant or deny such relief if the registered career offender demonstrates to the court that he or she has not been arrested for any crime since release and the court is otherwise satisfied that the registered career offender is not a current or potential threat to public safety.
